Terms of Service
Everyone's Design Studio Management ("Management") establishes these Terms for Everyone's Design Studio ("Service"). Please read the Terms before using the Service. Use of the Service signifies agreement to the Terms, subject to any additional consent required by law. This is an unofficial fan-made Heartopia support tool and is not affiliated with Heartopia's operator, affiliates or official organizations.
1. Application
These Terms govern the relationship between Management and users of the Service. Notices, posting rules, help pages and feature instructions form part of these Terms. These Terms prevail in case of conflict unless the individual notice expressly provides otherwise.
2. Definitions
"User" means anyone accessing or using the Service. "Posted Data" includes designs, images, converted or pixel data, canvases, titles, descriptions, nicknames, public profile information, optional social media accounts and Heartopia IDs that users create, save, publish or submit. "Published Data" means Posted Data made accessible to other users or third parties. "User Information" includes account identifiers, email addresses, usage and access records, inquiries, cookies and other information needed to provide, manage and analyze the Service. "External Services" include Google Login, Firebase, analytics, advertising and social sharing services.
3. Service Contents
The Service helps users create, edit, save, publish, view and share pixel art, clothing designs and related data intended for Heartopia. It assists creative work but does not guarantee acceptance or appearance in the game, third-party evaluations, compatibility with external services, compliance with external rules or absence of infringement. Please understand its features and limitations before use.
4. Free Features, Paid Plans and Ads
The Service provides free features and optional paid plans. Features, tax-inclusive prices, billing intervals, first-year offer conditions and renewal prices appear before enrollment and on the pricing help page. Monthly and annual subscriptions renew automatically until canceled. Annual plans are charged upfront for one year. The first-year offer is available once per account across all paid plans. Legacy plans retain their contracted prices and allowances. Review the selected plan and checkout conditions before purchase.
Manage your subscription and cancel automatic renewal in My Page. Complete cancellation before the next renewal to stop future renewals; access continues until the paid period ends. Upgrades within the same billing interval take effect after payment of the difference. Downgrades and billing-interval changes normally take effect at the next renewal. Review the amount and effective date shown before confirming.
We generally do not provide daily or monthly prorated refunds for cancellation for personal reasons or non-use. This does not apply to duplicate or incorrect charges, inability to provide paid features for reasons attributable to Management, or remedies required by law. We investigate and provide necessary corrections, re-performance, price reductions or refunds as appropriate. Account deletion does not automatically issue a refund. Payment, cancellation and refund inquiries are accepted through the contact form without signing in or at artpiatool@gmail.com. Japan payments use Stripe; new subscriptions in supported international locations are sold through Link. Link customers may also use Link's payment and refund support. Mandatory consumer rights are not restricted.
Eligible plans grant diamonds monthly based on payment, including annual plans. Each grant expires six months after it is issued. New AI generation requires an active eligible plan, such as Standard AI Generation or Premium AI Generation, and sufficient diamonds. Canceling renewal preserves access until the paid period ends. After that period, or after switching to a plan without AI, remaining diamonds cannot be used for new AI generation. Cancellation, plan changes and rejoining do not extend expiration dates. Rejoining an eligible plan before expiration permits use of the remaining valid balance. Account deletion removes the balance. Diamonds cannot be transferred between accounts or exchanged for cash, without limiting legally required refunds or other remedies.
AI image generation/conversion costs 50 diamonds per size; clothing generation costs 50 diamonds per generation. Regeneration costs another 50 diamonds each time. Check the displayed cost before execution. Diamonds are reserved at the start and consumed when the result is successfully generated and saved. Failed processing releases the reservation and restores unexpired diamonds; expiration is not extended if it occurs during processing. A successfully generated result that differs from your preferences is distinguished from a processing failure. This does not limit legal remedies for defects or nonconformity with the contract.
AI may change details, text, colors and shapes. Exact reproduction, originality, absence of infringement and game appearance are not guaranteed. Work-time and time-saving figures are estimates; actual results vary with the design, working method and experience.
Generation data is retained for 180 days from generation and is then eligible for automatic deletion. This limit does not apply to separately saved designs or work in progress. Save needed results before expiration. Users pay their own connection costs. Ads may appear in the Service.
Active Standard and Premium members can purchase additional diamonds in the Japan edition. The tax-inclusive amount shown at checkout is a one-time payment separate from the subscription. Diamonds are granted after payment verification and expire six months after successful payment. There is no automatic top-up. Using purchased diamonds also requires an active eligible AI plan. Diamonds expiring soonest are used first; plan renewal or changes do not extend their expiry. See https://art-pia.com/paid-plans.html for prices.
5. User Environment
Users are responsible for providing devices, browsers, software and network connections. Features may be unavailable or display differently depending on these conditions. Responsibility for environment-related display problems, delays, upload failures, data loss or other harm is subject to Section 22 and applicable law.
6. Login and Accounts
Some features require Google Login or another designated sign-in method. Users must protect their accounts and authentication information. Liability concerning unauthorized use, shared devices or account-management problems is governed by Section 22. If misuse is identified in the same or related accounts, Management may restrict access or remove data as appropriate.
Minors purchasing a paid plan must obtain consent from their legal representative. Age or other eligibility requirements of external services or individual features must also be satisfied.
7. Rights in the Service
Rights in the Service's software, design, interface, logos, text and systems belong to Management or the legitimate rights holders. Reproduction, modification, analysis, distribution, sale, rental or other use beyond the permission granted for using the Service is prohibited unless authorized.
8. Rights in Posted Data
Rights in Posted Data belong to the user or the legitimate rights holder. Users must obtain necessary permissions and check conditions when using third-party material, including characters, photos, logos, likenesses or text. Conversion, resizing or pixelation does not eliminate possible infringement. Rights in AI outputs belong to the user or legitimate rights holder to the extent those rights arise under law. We do not guarantee that copyright arises in every AI output or that other users will not receive similar results.
9. License for Published Data
Publishing grants Management a royalty-free, non-exclusive, worldwide license to display, share, introduce, promote, store, reproduce, resize, crop and convert that Published Data to the extent necessary for operating, maintaining, improving and introducing the Service. Ownership is not transferred. Users agree not to exercise moral or similar rights to the extent necessary for these permitted uses. Deletion or making data private may not remove previous external shares, announcements, caches or other copies outside Management's control.
10. Public Information
Published designs, titles, descriptions, nicknames, favorites and optional social media accounts or Heartopia IDs may be visible on public pages, details and sharing screens according to the publication settings. Do not publish names, addresses, phone numbers, email addresses, other people's personal information or information you do not want disclosed.
11. Use of Designs
Users may use designs to the extent they hold the required rights, while complying with Heartopia's rules, platform rules, applicable law and third-party rights. Users are responsible for checking rights before sharing, distributing, selling, commissioning or using designs commercially. Liability of Management is governed by Section 22.
12. Prohibited Conduct
Users must not use others' protected material without permission; infringe copyright, trademarks, likeness, privacy, reputation or other rights; post sexual, violent, discriminatory, threatening, harassing or otherwise inappropriate material; expose identifying information except their own optional profile fields; impersonate others; spam, overload or disrupt the Service; access systems without permission, exploit vulnerabilities or use abusive automation; harm users or third parties; violate law or public order; benefit antisocial groups; or engage in other conduct reasonably determined to be inappropriate for operation of the Service.
13. Removal and Restrictions
For violations or suspected violations, reasonable concerns about inappropriate content, rights complaints or other reasonably necessary operational reasons, Management may remove or hide data, adjust visibility or ranking, or restrict posting, saving, sharing, login or account use without prior notice. Individual explanations are provided when required by law.
14. Storage and Data Loss
The Service may store Posted Data, work in progress, settings and operational records. Permanent storage, full restoration, backups and uninterrupted access are not guaranteed. Outages, third-party changes, errors, misuse responses, maintenance or service termination may cause data to be lost, changed or inaccessible. Keep copies of important work. This does not exclude Management's responsibility under Section 22.
15. Changes, Suspension and Termination
Management may change, suspend or end the Service for reasonable reasons, including maintenance, security, legal compliance or external-service changes. Important paid-feature changes and ordinary service termination will be announced with reasonable advance notice, including the content, effective date and effect on subscriptions. If prior notice is impracticable because of an emergency or security issue, we will notify users promptly afterwards.
If termination at Management's discretion or similar circumstances prevent delivery of an already-paid service period, we will explain refunds corresponding to the unprovided period and the procedure or other appropriate remedies. For temporary failures, necessary restoration, re-performance, price reductions or refunds depend on the circumstances, duration and impact. Liability is governed by Section 22 and applicable law.
16. External Services
The Service may use Google Login, Firebase, Google Cloud, Google Analytics, Google AdSense, Stripe, OpenAI, Google Gemini, PixelLab and social sharing services. Their applicable terms, policies and technical limits also apply. Management's responsibility for external outages, changes, restrictions, data loss or disputes is governed by Section 22.
17. Ads, Links and Third-Party Content
The Service may show ads, links and third-party content. Transactions with external providers are between the user and that provider. Management's responsibility for such content or transactions remains subject to Section 22 and applicable law.
18. Personal Information
User Information is handled under the Privacy Policy, which explains collection, purposes, providers, cookies, analytics, advertising and contact procedures. Review that policy before use. Where law requires specific consent, it must be obtained separately as required; merely posting a policy is not a substitute.
19. Reporting Infringement
Report infringement, inappropriate posts or abuse through the contact form. Identify the content, the issue, your rights and relationship to the rights holder where applicable, and contact details needed for investigation. Management reviews reports and may remove, hide or restrict content as appropriate. A complete investigation or individual result report is not guaranteed, without limiting legal obligations.
20. Account Deletion
Request deletion in My Page > User settings after identity verification and final confirmation. Paid subscription termination is confirmed before related data is deleted. Remaining paid access then ends. Deletion does not automatically issue a refund and does not limit legally required remedies. The Privacy Policy explains what is deleted and retained.
Requests concerning your data may also be submitted through the contact form. We verify identity and consider technical limits and lawful retention requirements. Some backups, logs and legally required records may be kept for the necessary period. Removal of copies on other people's devices, search engines, social networks or external caches cannot be guaranteed.
21. Warranties
The Service is provided as is. Management does not guarantee accuracy, completeness, usefulness, continuity, security, suitability for a particular purpose, expected quality, exact game reproduction, external compatibility, absence of infringement, permanent data preservation or uninterrupted availability. These statements do not exclude liability or remedies under Section 22 or mandatory law.
22. Liability
Management is liable under applicable law for damage caused by a breach of contract or tort attributable to Management. Management is not liable for causes not attributable to it unless law provides otherwise.
For ordinary negligence (excluding intentional misconduct and gross negligence), compensation is limited to ordinary and direct damage and excludes special damage and lost profits. This limitation does not apply to intentional misconduct, gross negligence or where applicable law does not permit it.
All warranty disclaimers and liability exclusions elsewhere in these Terms are subject to this section. Nothing restricts rights under the Consumer Contract Act or other mandatory laws.
23. User Responsibilities
Users are responsible for their use of designs and third-party material. If a user's intentional or negligent violation of these Terms or infringement causes damage to Management or others, the user is responsible for resolving it and compensating Management to the extent permitted by law.
24. Antisocial Groups
Users represent that they do not belong to, support or provide benefits to antisocial groups. Management may suspend access or remove content without prior notice if involvement is reasonably identified.
25. Changes to the Terms
Management may amend these Terms when beneficial to users generally or when reasonable in light of necessity, proportionality and other circumstances and permitted by applicable law. We will announce the changes and effective date in advance. Important changes to paid prices or main features will include reasonable advance notice of timing, contractual effects and cancellation methods. Individual consent will be obtained when legally required; posting alone does not replace it.
26. Severability
If a provision is held invalid or unenforceable, the remaining provisions and valid portions continue in effect.
27. Governing Law and Jurisdiction
Japanese law governs these Terms. Courts with jurisdiction in Japan handle disputes at first instance except where applicable law provides otherwise. Mandatory protections and jurisdictional rights of consumers under applicable law are preserved.
28. Contact
Contact Management through the Service's inquiry form or artpiatool@gmail.com for questions, reports, rights issues or deletion requests. We review requests and respond as appropriate, subject to our legal obligations.
